Benihana and Time Out Terms and Conditions

HOW TO ENTER

This competition is organized by Time Out England Limited, company number 01782049 with registered offices at 1st Floor, 172 Drury Lane, London WC2B 5QR (“Time Out”) in association with Benihana (U.K.) Limited, company number 01950869 with registered offices at 77 King's Road, London, SW3 4NX (“Prize Provider”) (together, the “Promoters”). Please enter by filling out your details in the relevant form and you will be entered into a ballot, from which a winner and three (3) runner-up winners will be selected at random (the “Entry”). Submit your Entry by filling out the entry form found at https://www.timeout.com/london/things-to-do/win-a-luxury-dinner-for-two-at-benihana between Monday 24th July and Thursday 31st August 2023 for your chance to be selected as the Winner to win a luxury dinner for two (2) people at Benihana, which includes 2 x signature cocktails on arrival, 2 x selected appetisers, 2 x Benihana Royal Speciality Dinner, which includes chateaubriand, scallops and lobster and accompanied by Benihana onion soup, salad with ginger dressing, prawn appetizer, hibachi vegetables and steamed rice, and  2 x ice creams (tempura or mochi) (the “Star Prize”), or your chance to be selected as one of the 3 x runner-up winners to win dinner for two (2) people at Benihana, which includes 2 x signature cocktails on arrival, and 2 x Land & Sea Speciality Dinner, featuring miso black cod and filet mignon and accompanied by Benihana onion soup, salad with ginger dressing, prawn appetiser, hibachi vegetables and hibachi rice (the “Runner-up Prize”) (the “Competition”). 

HOW IT WORKS

GENERAL COMPETITION TERMS & CONDITIONS 

1. The Competition begins at 12:15am on Monday 24th July (the “Start Date”). The Competition closes at 11:45pm on Thursday 31st August (the “End Date”).  

1. The Competition is open to all UK residents over the age of 18, except employees of Time Out and the Prize Provider, its agents, contractors and their family members.
2. Multiple entries will not be accepted. 
3. By uploading your Entry, you understand that you are entering the Competition and agree to these Competition rules (the “Rules”). Time Out reserves the right to exclude any Entry from the Competition at any time if they have a reason to believe that the entrant has breached any of the Rules. 
4. Copyright in all Entries submitted for this Competition remains with the respective entrants. However, entrants agree that by submitting an Entry to the Competition, they grant Time Out a royalty free, perpetual irrevocable worldwide licence to use and republish their Entry. This includes sharing the Entry through social media and publication by Time Out worldwide in any of their publications, their websites and/or in any promotional material. 
5. The Winners will be notified by Time Out by email within 5 days of the End Date. 
6. The winner will be selected at random from a computer-generated ballot (the “Winner”). The Winner will be removed from the ballot and the runner-up winner will be selected at random from a computer-generated ballot (the “Runner-up”). The Runner-up will be removed from the ballot and the second runner-up will be selected at random from the computer-generated ballot (the “Second Runner-up”). The Second Runner-up will be removed from the ballot and the third runner-up will be selected at random from the computer-generated ballot (the “Third Runner-up”) (together, the “Winners”)
7. The prize for the Winner is the Star Prize and the prize for each of the Runner-up, Second Runner-up and Third Runner-up is the Runner-up Prize. 
8. The Winners must be aged 18 or over.
9. All Entries must be submitted by the original writer of the Entry. 
10. The Winners may be required to participate in publicity which may include having their photographs taken for promotional and press purposes.  
11. All Entries considered inappropriate or offensive by Time Out will be disqualified. 
12. The Star Prize and the Runner-up Prize will be provided by the Prize Provider and is subject to their terms and conditions available at INSERT LINK TO PRIZE PROVIDER T&Cs. 
13. The Winners will be notified by Time Out within 5 days of the End Date using the contact information submitted when uploading their Entry. The winner may be asked to provide identification. Any of the Winners who are not contactable or who fails to return contact within 72 hours of notification will be disqualified, they thereby forfeit their right to the prize, no compensation will be given and a reserve entrant will be selected as an alternative winner. 
14. The names of the Winners may be obtained by sending a written request with a stamped addressed envelope stating which competition you would like the winner’s details for, to Time Out England Limited, 1st Floor, 172 Drury Lane, London WC2B 5QR or by email to competitions@timeout.com by INSERT DATE THAT IS ONE MONTH AFTER THE END DATE.
15. Any Winners details shared will be limited to surname and country only, in accordance with ASA guidelines on the EU and UK General Data Protection Regulation. 
16. The Star Prize and Runner-up Prize is non-negotiable, non-transferable and non-refundable, and subject to availability. 
17. Time Out accepts no liability for any loss or damage howsoever caused, including but not limited to indirect or consequential loss or damage or personal injury (with the exception of death or personal injury caused by Time Out’s own negligence) suffered or sustained in connection with the Prize Package.
18. In the event of unforeseen circumstances Time Out and the Prize Provider reserve the right to substitute the Star Prize and the Runner-up Prize for an alternative of equal or greater value. 
19. Time Out accepts no responsibility if the Prize Provider refuses to issue the Star Prize or the Runner-up Prizes. 
20. If an act, omission, event or circumstance occurs which is beyond the reasonable control of Time Out and/or the Prize Provider and which prevents Time Out and/or the Prize Provider from complying with the Rules, neither Time Out or the Prize Provider will be liable for any failure to perform or delay in performing their obligations. Time Out reserves the right to modify, delay, postpone or cancel the Competition in the event of circumstances outside of its reasonable control. 
21. This Competition and the Rules shall be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts. 
22. By entering the Competition, all entrants consent to the processing of their personal data by Time Out for the purposes of administration of this Competition.

The Competition promoters are Time Out and the Prize Provider. Time Out shall have the right to license all and any rights granted to Time Out to its associated companies and licensees.

SPECIFIC TERMS & CONDITIONS FOR THE STAR PRIZE AND RUNNER-UP PRIZE:

1. Non-transferable, not redeemable for cash and is not subject to any alternative prizes. 
2. Must be redeemed by [enter the date]. 
3. Reservations can only be made at Benihana Covent Garden located at 31 Maiden Lane, Covent Garden, London, WC2E 7JS or Benihana located at Chelsea 77 King’s Road, London, SW3 4NX. 
4. Reservations can be made at any time on any date, subject to availability. Reservations should be sent to simon@collaborator.ltd.uk.
5. Prize Provider can provide a vegetarian or gluten-free alternative.
